Terms of Service

These terms are an agreement between you and OmniMinds, the maker of BothHeard, for your use of BothHeard — our website and our forthcoming mobile and web apps. By using BothHeard, you agree to them. Please read the coaching notice in section 3 carefully.
1. Who we are
BothHeard is created and run by OmniMinds ("we," "us"). You can reach us at hello.bothheard@gmail.com.
2. Eligibility
You must be at least 18 years old to use BothHeard. By using it, you confirm that you are, and that the information you give us is accurate.
3. What BothHeard is — and is not
BothHeard is a relationship coaching service delivered with the help of AI. It is not therapy, counseling, medical or mental-health care, diagnosis, or treatment, and it is not a substitute for professional care. Your coach is an AI, not a human and not a licensed professional. Where we help you connect with a licensed counselor, that professional — not BothHeard — is responsible for the care they provide.
Not for emergencies. BothHeard is not a crisis or emergency service. If you or someone else may be in danger, or you're experiencing a mental-health crisis, contact your local emergency services or a crisis line immediately.
4. Your account
You're responsible for keeping your login secure and for activity under your account. Tell us promptly if you suspect unauthorized use. Early access is offered by invitation and may be limited, changed, or withdrawn.
5. The consent wall and shared spaces
BothHeard uses two private rooms and one shared room. You control what, if anything, moves from your private space into a shared space with a partner, and you can revoke sharing at any time going forward. You agree not to misuse shared spaces — for example, to harass, threaten, or abuse another person.
6. Acceptable use
You agree not to:
- Use BothHeard for anything unlawful or harmful.
- Attempt to break, reverse-engineer, overload, or gain unauthorized access to the service.
- Upload content you don't have the right to share, or impersonate someone else.
- Use the service to harm, exploit, or endanger anyone.
7. Payments
Some features will be paid (for example, a couple plan). When paid plans launch, prices, billing cycles, and cancellation terms will be shown before you subscribe. Purchases made through an app store are also subject to that store's terms.
8. Your content
You keep ownership of what you share. You grant us a limited license to process it solely to operate and improve the service for you, consistent with our Privacy Policy. We don't sell your content, and we don't use it for advertising.
9. Intellectual property
BothHeard, its name, logo, software, and content (other than your own) are owned by OmniMinds or its licensors. You get a personal, non-transferable, revocable right to use the service under these terms.
10. AI limitations
AI can be helpful, but it can also be wrong or incomplete. BothHeard's suggestions are for reflection and communication support, and you're free to disregard them. Use your own judgment, and seek a qualified professional for decisions that need one.
11. Disclaimers
The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties not expressly stated here, including fitness for a particular purpose. We don't guarantee any specific relationship outcome.
12. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of BothHeard. Nothing in these terms limits liability that cannot be limited by law.
13. Termination
You can stop using BothHeard and delete your account at any time. We may suspend or end access if these terms are breached or to protect the service and its users.
14. Changes
We may update these terms as the product evolves. We'll change the date above and, for significant changes, give you notice. Continuing to use BothHeard after changes means you accept them.
15. Governing law
These terms are governed by the laws of the operator's place of residence, without regard to conflict-of-laws rules, except where local consumer-protection law gives you stronger rights.
